Heard learned counsel for the petitioner as well learned Standing Counsel for the State-respondent and perused the material brought on record. 2. The present petition has been filed by the petitioner with the following prayer: "(i) issue a writ, order or direction in the nature of Mandamus commanding and thereby directing to the opposite party no.1 to 3 to remove the illegal encroachment made by the opposite party no.5 to 9 over the land Gata No.77/0.343 hect. recorded as "Pashuchar bhumi" and Gata No.55/0.152 hect. recorded as "Rasta" in the revenue record in the Village-Kandaila, Pargana-Haveli Awadh, Tehsil-Sohawal, District- Ayodhya, in the interest of justice." 3. Learned Standing Counsel, based upon instructions, states that on one of the Gatas, the proceedings under Section 67 of the U.P Revenue Code have already been initiated and on the other Gata, the obstructions have already been removed. 4. Learned counsel for the petitioner opposes the above said submissions. 5. In view of the rival contentions, the present petition is disposed of permitting the petitioner to approach the appropriate authorities by filing an application under Section 67 of U.P. Revenue Code in respect of the property, in which, it is stated that the encroachment have been removed. In case, the same is filed, the same shall be decided with all expedition within the time, as prescribed in the statute, in accordance with law.
