The appeal has been filed against the summoning order dated 31.03.2025 and charge sheet as well as for quashing the proceedings of Criminal Case SC No.570 of 2021; State Versus Akash Yadav and others, Crime No.9 of 2021, under Sections 323, 504, 506 IPC and 3(1)Dha, 3(2)VA SC/ST Act, Police Station-Itaunja, District Lucknow pending in the court of Special Judge, SC/ST Act, Lucknow. Learned counsel for the appellants, after arguing at some length does not want to press the appeal on merit and submits that the appeal may be dismissed as not pressed so that they may appear before the concerned court and seek the benefit of the order of Hon'ble Supreme Court passed in the case of Satendra Kumar Antill Vs. Central Bureau of Investigation and Others, 2022 SCC OnLine SC 825. To which there is no objection by learned A.G.A. In view of above, this appeal is dismissed as not pressed with the liberty as aforesaid. It is needless to say that in case the appellants appear before the concerned court within a period of ten days from today and claim the benefit of the judgment passed in Satendra Kumar Antill Vs.
