1. The petitioner in the present petition is aggrieved by the sealing of his property bearing plot no. 247, 248, Nangli Sakrawati, Najafgarh, New Delhi vide notice dated 05.03.2025 issued by the concerned SDM (South-West, Dwarka). 2. The petitioner seeks that the respondent nos. 1 to 3 be directed to de- seal the property of the petitioner on the premise that the impugned sealing action was occasioned on account of a recovery certificate issued by the Deputy Labour Commissioner (District South West, DTC Colony Pratap Nagar, Hari Nagar, New Delhi-110064) in proceedings concerning the firm (M/s Dogma Auto Industries) of the erstwhile tenant of the petitioner i.e., respondent no.4/Mr. Tejvir Singh. 3. It is submitted that the petitioner is in no way either concerned/related with the said proceedings or with regard to the liability of its erstwhile tenant which resulted in the impugned sealing of the property in the question. It is emphasised that the sealing was occasioned only on account of the fact that the respondent no.4 (ex-tenant of the petitioner) was embroiled in the proceedings before the Labour Commissioner. 4. It is further submitted that an application for de-sealing of the property has been filed by the petitioner before the concerned authorities. However, the same is not being considered and decided by the concerned authority. 5. In the circumstances, with the consent of learned counsel for respondent nos. 1 and 2, who appears on advance notice, it is directed that the concerned SDM shall decide the application of the petitioner for de- sealing of the concerned premises within a period of three weeks from today. 6. Let a hearing be granted by the concerned SDM to the petitioner and necessary orders on the application of the petitioner seeking desealing of the proerty, be duly passed. 7.
Needless to say, if the petitioner is aggrieved with the outcome of the aforesaid exercise, he shall be at liberty to avail appropriate remedies under law. 8. The present petition stands disposed of in the above terms. SACHIN DATTA, J APRIL 22, 2025/uk
