This petition under Section 439(2) of Cr.PC is filed by the State with a prayer to cancel the anticipatory bail granted to respondent-accused by the coordinate bench of this Court in Crl.P.No.4066/2020 disposed of on 05.10.2020. 2. Heard the learned HCGP for the petitioner-State. 3. Respondent, who was arrayed as an accused in Crime No.59/2020 registered by Cubbon Park Police Station, Bengaluru, for the offence punishable under Section 420 of IPC, had approached this Court in Crl.P.No.4066/2020 seeking anticipatory bail. The coordinate bench of this Court considering the nature of allegations found in the first information had allowed Crl.P.No.4066/2020 by order dated 05.10.2020 and the respondent-accused was granted anticipatory bail in Crime No.59/2020 registered by Cubbon Park Police Station, Bengaluru. On the ground that respondent-accused has not cooperated with the police for the purpose of investigation, this petition is filed seeking cancellation of anticipatory bail after a period of two years from the date of the order. - 3 - HC-KAR NC: 2025:KHC:25876 CRL.P No. 1285 of 2022 4. Though this petition is pending before this Court for the last two years, notices issued to the respondent is not served. The police report with regard to service of notice on respondent-accused would go to show that respondent is not available in the address mentioned in the cause title of the petition. Though FIR has been registered in the year 2020, till date investigation of the case is not completed and charge sheet is not filed. Considering the nature of allegations found in the first information, it appears that interrogation of the accused may not be required for the purpose of completing the investigation, since the allegations in the first information are based on documentary evidence which in normal circumstances would be available with the first informant.
