Neutral Citation No. - 2025:AHC-LKO:44386 Court No. - 18 Case :- WRIT - A No. - 8373 of 2025 Petitioner :- Nisha Yadav Respondent :- State Of U.P. Thru. Prin. Secy. Bal Vikas Pushtahar Lko And 6 Others Counsel for Petitioner :- Chandresh Mani Shukla Counsel for Respondent :- C.S.C.,Pankaj Gupta Hon'ble Manish Mathur,J. Heard learned counsel for petitioner and learned State Counsel for opposite parties 1 to 6. In view of order being passed, notice to opposite party No.7 stands dispensed with. Petition has been filed challenging selection list dated 8th April, 2025 pertaining to selection on the post of Aganbari worker in the village concerned as also seeking a direction for issuing a fresh selection list considering petitioner's application dated 15th May, 2025. Learned State Counsel has been provided written instructions dated 25th July, 2025, which are taken on record and as per which the petitioner as well as selected candidate applied under the below poverty line category but petitioner's candidature was not considered in view of the fact that she had indicated an incorrect date of birth and domicile certificate number in her application due to which her domicile certificate could not be verified. It is also being stated that since specific condition was indicated in the application form that in case of incorrect submission, application would not be considered, petitioner's candidature has not been considered.
Learned counsel for petitioner on the basis of instructions received submits that the petitioner being a widow lady inadvertently made this mistake which was also rectified during course of document verification and an affidavit to that effect was also submitted and therefore application should have been taken into consideration. In view of submissions advanced by learned counsel for parties and perusal of material on record, it is evident and admitted that petitioner has indicated incorrect details in her application form. Even if such an aspect was inadvertent, due to such mistake, her domicile certificate was not verified and therefore her candidature was not considered. In view of aforesaid, this Court does not find any arbitrariness
or illegality in selection of opposite party No.7, the petition therefore fails and is dismissed. Parties to bear their own cost.
