Also heard Mr. R J Baruah, learned Additional Public Prosecutor, Assam. This application has been filed praying for modification of the order dated 25.06.2025 passed by this court in BA No. 1308/2025. According to Mr. Chauhan, the petitioner Duryodhan Yadav being the informant had filed the said Bail Application No. 1308/2025 praying for cancellation of the bail granted by the learned Sessions Judge, Hojai, Sankardev Nagar. On that day, on the submission of the learned Additional Public Prosecutor, Assam the petitioner was directed to approach the trial court for seeking regular bail as chargesheet was filed against the respondent no. 2. hearing the learned counsel for both sides, this court is of the opinion that instead of modification of the order aforesaid, the court should pass a fresh order in a new case. Therefore, the petitioner is directed to file a fresh bail application praying for cancellation of the bail granted by the learned Sessions Judge, Hojai.
