Page No.# 2/2 A challenge is made to an Order dated 02.08.2023 in this criminal petition. The Order dated 02.08.2023 was passed by the Court of learned Judicial Magistrate First Class, Udalguri [‘the Trial Court’, for short] in connection with Orang Police Station Case no. 91/2022 when the investigation of the case was not complete. A period of two years has passed since 02.08.2023. The investigation of the case must have progressed considerably or been completed during the interregnum. The prayer for interim custody of currency notes amounting to Rs. 3,30,000/- was rejected by the said Order dated 02.08.2023. In view of the changes in circumstances by the elapse of two years, the petitioner has submitted that the petitioner would make a fresh application for interim custody of the said currency notes before the learned Trial Court. In view of the above submission made on behalf of the petitioner, the instant criminal petition is dismissed as not pressed, reserving the liberty to the petitioner to approach the learned Trial Court, as submitted above.
