Heard, Shri Parashu Ram Kanaujia, learned counsel for the applicant and learned A.G.A. This application under Section 482 Cr.P.C./528 of BNSS has been filed challenging the summoning order dated 21.02.2023 in Complaint Case No.4461 of 2022; Smt. Gurumeet Kaur Versus Gurumel Singh alias Manga Singh, under Sections 498-A, 323, 504, 506 IPC and 3/4 D.P.Act issued by the ACJM-IV, Court No.28, Lucknow and the order dated 15.01.2025 by means of which non-bailable warrant has been issued against the applicant. Once the applicant had appeared before the trial court, he could not have challenged the order dated 21.02.2023. So far as the order dated 15.01.2025 is concerned learned counsel for the applicant failed to show any reason as to why he has not appeared and not appearing since then, therefore, the appeal is misconceived. It is, accordingly, dismissed. .................. .......................................(Rajnish Kumar,J.)
