The Counsel for the respondent is present. 2. The matter is pending since 2013. A perusal of the award dated 04.07.2012 reveals that vide order dated 12.03.2010, a prima facie, view was formed by the Tribunal that the inquiry held is improper and unfair and chance was given to the management to adduce evidence to substantial the charges levelled against the workman. Despite two years being passed, no efforts were made to adduce evidence before the Tribunal, as such, the award was passed. 3. The Counsel for the respondent states that the said issue was considered by this Court extensively in the case of Bank of India and others vs Central Government Industrial Tribunal-cum-Labour Court and another (Writ-C No.19385 of 2018): decided on 18.05.2022. The said judgement was upheld by Hon'ble Supreme Court vide judgement dated 20.02.2024 passed in Special Leave to Appeal (C) No.19695 of 2022 (Bank of India and others vs Bank of India and another).
