Heard learned counsel for petitioner and learned State Counsel for opposite parties. Petition has been filed seeking payment of post retiral benefits to petitioner alongwith interest. However it transpires from record that petitioner was earlier dismissed from service vide order dated 20th July, 1974, which was challenged in writ petition No. 1033 of 1974 and in which although interim protection was granted to petitioner but learned counsel for petitioner submits that he does not have any information with regard to final decision taken. In the considered opinion of this Court, the final adjudication of the said writ petition would have a bearing on grievances raised by petitioner particularly in case the said petition was dismissed thereby upholding dismissal order whereunder petitioner would not be entitled for the aforesaid benefits. However since factual aspects are required to be considered for redressal of petitioner's grievance,liberty is granted to petitioner to make a fresh representation before opposite party No.2 i.e. Commissioner, Rural Development, U.P. or any other competent authority. In case such a representation is filed, the same is required to be decided within a period of eight weeks from the date a certified copy of this order is produced before the said authority.
