Neutral Citation No. - 2025:AHC-LKO:45433 Court No. - 8 Case :- WRIT - A No. - 8674 of 2025 Petitioner :- Deepak Yadav Respondent :- Staff Selection Commission (Combined Graduate Level), New Delhi, Thru. Chairman And Another Counsel for Petitioner :- Abhinandan Kumar Pandey,Vimlesh Tiwari Counsel for Respondent :- A.S.G.I. Hon'ble Manish Mathur,J.
1. Heard learned counsel for petitioner and Mr. S.B.Pandey, learned Senior counsel/Deputy Solicitor General of India assisted by Mr. Varun Pandey, learned counsel for opposite parties. 2. Petition has been filed challenging advertisement dated 09.06.2025 whereby the cut off date for age limit for candidates has been prescribed. Further prayer for a direction to opposite parties to grant age relaxation to appear in Combined Graduate Level Examination-2025 has also been sought. 3. It has been submitted that in earlier round of examination from 2019 till 2024, the cut off date for purposes of participation in aforesaid examination was always taken from First January of the calendar year but in the present round, that has been shifted to First August due to which petitioner would be rendered over age. 4. Learned counsel for opposite parties has refuted submissions advanced by learned counsel for petitioner with the submission that petitioner has not been able to indicate any provision of law where under such relief can be granted. 5. Upon consideration of submissions advanced by learned counsel for parties and perusal of material available on record, it is evident that sole ground taken is that due to fixing of cut off date for determination of age from first January to first August in the advertisement dated 09.06.2025, the petitioner would become over age by 28 days and is therefore against the provision of Articles 14 and 21 of Constitution of India. However, learned counsel for petitioner has not been able to demonstrate any arbitrariness in the fixing of cut off date for
reckoning the age limit for candidates. The principles of arbitrariness do not apply in a vacuum and has to be demonstrated through material on record. In the present case, petitioner has not been able to indicate or demonstrate any arbitrariness in fixing of cut off date nor any right vested in it for grant of relief as prayed for. 6. Considering the aforesaid aspects, petition fails and is hereby dismissed at the admission stage itself. Parties to bear their own costs.
