The petitioner has moved before this Court for grant of privilege of anticipatory bail from apprehending his arrest in connection with Mayurhand P.S. Case No.13 of 2025 registered under Sections 303(2), 317 of B.N.S. and section 21 of MMDR Act 1957, Section 4/54 of JMMC Rule 2004 and Rule 13 of the Jharkhand Minerals (Prevention of Illegal Mining Transportation and Storage) Rules 2017. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case and has not committed any offence as alleged in the F.I.R. As per allegation, one tractor bearing Engine No. RHC2EAN3424, Chasis No. MBNABAEXPHRC 01973, Bearing Registration No.JH-13-D-6076 loaded with illegal sand was intercepted by Mayurhand Police. The petitioner has no concern with the seized sand. He has falsely been implicated in this case because he happens to be the owner-cum-driver of the alleged vehicle. There is no criminal antecedent against the petitioner as stated in paragraph no.12 of the anticipatory bail application. 4. Learned A.P.P. opposed the prayer for bail. 2025:JHHC:14390 Page | 2 5. Having regard to the facts of the case, I am inclined to grant privilege of anticipatory bail to the petitioner. Accordingly, the petitioner is directed to surrender in the Court below within four weeks from today and in the event of his arrest or surrender, he will be enlarged on bail on furnishing bail bond of Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Chatra in connection with Mayurhand P.S. Case No.13 of 2025 with the condition that he will co- operate with the investigation of the case and appear before the investigating officer as and when noticed by him and furnish his mobile number and photocopy of the Aadhaar Card with an undertaking that he will not change his mobile number during the pendency of the case and subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. It is made clear that if the petitioner does not cooperate with the investigation/trial, the State would be at liberty to take appropriate action. (Deepak Roshan, J.) Sandeep/Rahul
