These two Criminal Petitions have been filed under Section 528 Bharatiya Nagarik Suraksha Sanhita Act, 2023 (for brevity the ‘BNSS’) by the petitioners/accused Nos.1 to 3, seeking to quash the proceedings against them in C.C.No.994 of 2023 (Crime No. 54/2023 dated: 17.09.2023 registered for the offence punishable under Section 498-A of Indian Penal Code, 1860 (for brevity ‘the IPC’), and Sections 3 and 4 of Dowry Prohibition Act, 1961 (for brevity ‘the D.P. Act’) on the file of Disha Police Station, Krishna District, Machilipatnam) on the file of the learned Special Judicial First Class Magistrate (Prohibition and Excise), Court Machilipatnam. 3. An application has been filed in I.A.No.2 of 2026 in Crl.P.No.2745 of 2026 seeking permission to permit the GPA holder/father of Accused No.1, to represent, appear, sing and depose on behalf of the petitioner/Accused No.1, who is residing in United State of America, and the same is allowed. 4 4. I.A.No.3 of 2026 in Crl.P.No.2745 of 2026 and I.A.No.1 of 2026 in Crl.P.No.1049 of 2025 are filed by the petitioner/de-facto complainant/ respondent No.2 seeking permission to permit the respondent No.2/de- facto complainant to compromise the matter with respondents/accused Nos.1 to 3 and to compound the offences under Section 498-A of ‘the IPC’ and Sections 3 and 4 of ‘the D.P.Act’, in Crime No.54/2023, on the file of Disha Police Station, Krishna District, Machilipatnam. 5. I.A.No.4 of 2026 in Crl.P.No.2745 of 2026 and I.A.No.2 of 2026 in Crl.P.No.1049 of 2025 are filed by the petitioner/de-facto complainant/ respondent No.2 seeking to record compromise between the petitioner/de- facto complainant and the respondents/accused Nos.1 to 3 as per the joint memo and quash the proceedings against the respondents/accused Nos.1 to 3 in Crime No.54/2023 on the file of Disha Police Station, Krishna District, Machilipatnam. 6. Today, when the matters were taken up for hearing, the petitioners/accused Nos.1 to 3 and respondent No.2/de-facto complainant were present before this Court. They produced their respective attested copies of Aadhar cards in proof of their identity, and the same were placed on record for proper identification. Both the learned counsel on record identified both the parties in open Court. 5 7. Ms. P. Akhila Naidu, learned Assistant Public Prosecutor for the State, and the learned counsel for respondent No.2 have reported no objection to recording the compromise. 8. This Court enquired of the respondent No.2/de-facto complainant regarding her willingness to enter into a compromise in the matter. She represented before the Court that she has voluntarily come forward to enter into the compromise. The de-facto complainant further stated that the case may be closed against the accused persons and that she does not wish to prosecute the matter, as the dispute has been settled amicably. It is also submitted that respondent No. 2 and the petitioners/Accused Nos.1 to 3 have entered into a Memorandum of Understanding, and the terms of compromise have been reduced into writing and duly recorded in an Award passed in Lok Adalat Case No.188 of 2026 in D.V.C.No.193 of 2024 on the file of the learned I Additional Chief Judicial Magistrate, Vijayawada, dated 14.04.2026, which is final and binding on both parties. 9. Considering the submissions and in the light of the judgment of the Hon’ble Apex Court in Gian Singh vs. State of Punjab and another1, since there is an amicable settlement between the parties, in the interest of justice, I.A.Nos.1 and 2 of 2026 in Crl.P.No.1049 of 2025 and I.A.Nos.2 to 4 of 2026 in Crl.P.No.2745 of 2026 are allowed. 10. Consequently, these two Criminal Petitions are allowed, and the cases against the petitioners/Accused Nos.1 to 3 in C.C.No.994 of 2023 1 2012(10)SCC 303 6 (Crime No.54/2023 dated: 17.09.2023 registered for the offence punishable under Section 498-A of ‘the IPC’, and Sections 3 and 4 of ‘the D.P. Act’, on the file of Disha Police Station, Krishna District, Machilipatnam) on the file of the learned Special Judicial First Class Magistrate (Prohibition and Excise), Court Machilipatnam, are hereby quashed.
