The petitioner has moved before this Court for grant of privilege of anticipatory bail from apprehending his arrest in connection with Barwadda P.S. Case No.156/2021 (G.R. No.3020/21) registered for the offences under Sections 25(1-B) (a), 25 (6), 26 & 35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that the petitioner has been implicated only on the basis of confessional statement of the co-accused person who was arrested from the spot. He further submits that the petitioner was not present at the place of occurrence; he is not named in the FIR; no incriminating article has been recovered from the conscious possession of the petitioner and the allegation is general and omnibus in nature; that the other co-accused has been granted anticipatory bail in A.B.A. No.7390/2024. He further submits that the petitioner is ready to abide by all the terms and conditions as imposed by this Court.

Learned A.P.P. opposes the prayer for anticipatory bail of the petitioner.

Having regard to the facts of the case and looking to the allegation made against this petitioner coupled with the fact that the
2025:JHHC:14334 2 petitioner is not named in the FIR and no incriminating article has been recovered from the conscious possession of the petitioner; therefore, I am inclined to enlarge this petitioner on anticipatory bail. Accordingly, the petitioner is directed to surrender before the court below within a period of four weeks from today and the learned court below on his surrender shall release him on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of learned JMFC, Dhanbad in connection with Barwadda P.S. Case No.156/2021 (G.R. No.3020/21).

It is made clear that the petitioner shall cooperate with the investigation/trial and if he will not cooperate with the investigation/trial, the State shall be at liberty to take appropriate action.
