Hon'ble Manish Mathur,J.
1. Heard learned counsel for petitioner and Mr. S.B. Pandey, learned Deputy Solicitor General of India assisted by Mr. Dev Rishi Kumar, learned counsel for opposite parties.
2. Petition has been filed challenging order dated 02.03.2022 and the appellate order dated 15.02.2022 whereby petitioner has been visited with major penalty alongwith recovery.
3. Learned counsel for opposite parties have raised a preliminary objection regarding maintainability of this petition in view of petitioner having an alternative and equally efficacious remedy of approaching the Central Administrative Tribunal, which also has the power condone delay.
4. Learned counsel for petitioner does not dispute the aforesaid fact but submits that alternative remedy is not an absolute bar for entertaining a writ petition.
5. However, in view of the fact that punishment and appellate orders are under challenge, in the considered opinion of this Court, petitioner would have a better efficacious remedy of approaching the Tribunal.
6. In view thereof, petitioner is granted liberty to approach the Central Administrative Tribunal with regard to challenge to the aforesaid orders. In case any such petition is filed, the same may be decided expeditiously, if delay is condoned.
7. With aforesaid directions, petition stands disposed of. Order Date :- 29.7.2025 Satish Digitally signed by :- SATISH KUMAR BHARATI High Court of Judicature at Allahabad, Lucknow Bench
