JUSTICE H.P.SANDESH ORAL ORDER Both the parties and their respective counsel are present. 2. Learned counsel for both the parties have filed an application under Section 147 of Negotiable Instruments Act, 1881 (‘N.I. Act’ for short) compounding the sentence in view of the settlement arrived between the parties. 2. The respondent has acknowledged receipt of amount of Rs.70,000/- from the petitioner and already Rs.60,000/- is in deposit before the Trial Court. In terms of the settlement, the respondent is permitted to withdraw the amount and the petitioner has no objection to withdraw the amount. 3. In view of the settlement arrived between the parties, the application filed under Section 147 of N.I. Act is - 3 - NC: 2025:KHC:4287 CRL.RP No. 173 of 2023 allowed. The offence is compounded and petitioner is acquitted for the offence under Section 138 of N.I. Act. 4. Accordingly, the criminal revision petition stands disposed of. The petitioner is directed to pay the amount of Rs.5,000/- as ordered by the Trial Court within one week from today and produce the receipt before the Registry for having paid the amount of Rs.5,000/- before the Trial Court. If the said receipt is not produced, the Registry is directed to put up this matter on 12.02.2025. If the receipt is produced, there is no need to put up the same.
