APHC010196892025 IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI WP(PIL) NO: 85 of 2025 Bench Sr.No:-4 [3483] Pallikonda Francis ...Petitioner Vs. The State of Andhra Pradesh and others ...Respondents ********** Advocate for Petitioner : Mr. G Sai Narayana Rao Advocate for Respondent : GP for Revenue for R.1 to R.5 CORAM : THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE RAVI CHEEMALAPATI DATE : 30th April, 2025 P C : The present petition has been filed highlighting the inaction of the official respondents in not taking action against private respondent Nos.6 & 7 who were said to have encroached the land belonging to the Government. In this regard, learned Government Pleader for the Revenue Department states that action has been taken and a show cause notice has been issued and served upon private respondent No.7 in terms of BSO 15(12)(3)(b). 2 HCJ & RC, J WP(PIL)_85_2025 Learned counsel for the petitioner, however, states that action initiated is only partial action inasmuch as apart from the land which was assigned to respondent No.7 which has not been brought under cultivation within the prescribed period, there is additional parcel of land which has been encroached by respondent No.6 against which no action has been taken. Considering the limited nature of controversy, the present petition is disposed of with a direction to the District Collector, Anakapalle, to consider the representation of the petitioner and take appropriate action in accordance with law. The notice already issued to respondent No.7 be also taken to its logical conclusion. No order as to costs. Miscellaneous applications pending, if any, shall stand closed.
