Tyagi, learned senior counsel assisted by Mr. Pulak Agarwal, learned counsel for the revisionist/landlord. 2. Mr. Siddhartha Singh, learned counsel for the respondent/tenant. 3. The present matter was heard at length on 17.12.2025 and after arguing at length learned counsel for the revisionist/landlord proposes two years’ time to the respondent/tenant to vacate the shop in question and on such proposal the respondent/defendant was asked to file an affidavit and today the supplementary affidavit is filed by the respondent/defendant proposing three years time to vacate the shop in question. 4. Mr. M.S. Tyagi, learned senior counsel submits that three years period is too long and the revisionist is proposing only two years time. 5. In such view of the matter since the respondent/tenant is now ready to vacate the shop in question, however he wants three years’ time, which appears to be unreasonable, therefore, this court is of the view that two years and six months is sufficient time to vacate the shop in question. 6. In such view of the matter with the direction to the respondent/tenant to vacate the shop in question with 2 ½ years from today i.e. on or before 30.06.2028. 7. It is made clear that the respondent shall pay the monthly rent regularly and will hand over the peaceful possession to the revisionist on or before the aforesaid date. 8. It is further made clear that in respect of the aforesaid undertaking the respondent/tenant shall file an affidavit before the SCC court within two weeks from today positively. 9. It is further made clear that if the respondent/defendant failed to vacate the shop in question on or before the aforesaid date the liberty is given to the petitioner to take appropriate steps to get the shop vacated with the assistance of district administration.
