Neutral Citation No. - 2025:AHC:20535 Court No. - 7 Case :- WRIT - A No. - 1827 of 2025 Petitioner :- Munni Lal And 6 Others Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Praveen Kumar Singh Counsel for Respondent :- C.S.C. Hon'ble Prakash Padia,J. 1. The petitioner claims the payment of arrears of salary for the period commencing from April, 2013 to September, 2014. 2. Sri Praveen Kumar Singh, learned counsel for the petitioner submits that a representation has been made in this regard but to no avail. 3. The only prayer made by the petitioner is that the representation of the petitioner be decided within a stipulated period of time. 4. Learned Standing Counsel submits that the payment of salary requires factual determination as per applicable laws by the competent authority in the first instance. He, however, fairly submits that the matter is liable to be decided within a reasonable time frame. 5. In wake of the preceding discussion and without going into the merits of the case, interest of justice will be served by directing the respondent no.2- Director, Social Welfare Department, U.P., Lucknow to decide the representation of the petitioner for payment of arrears of salary within a period of three months from the date of receipt of a certified copy of this order alongwith a fresh copy of representation. 6. In view of the delay on the part of the petitioner in approaching this Court, the petitioner shall not be entitled for interest for the arrears of salary, if it is found by the authority concerned that petitioner is entitled for the salary for the period as prayed for in the writ petition. 7. The writ petition is accordingly disposed of. Order Date :- 13.2.2025 Pramod Tripathi Digitally signed by :- PRAMOD TRIPATHI High Court of Judicature at Allahabad
