The instant revision has been preferred seeking following main relief(s):- "Wherefore it is most respectfully prayed that this Hon'ble Court may kindly be pleased to quash the order dated 19.07.2024 passed by Learned Additional Principal Judge, Family Court no. 1st Hardoi in Maintenance Case no. 398/2020, U/s 125 Cr. P.C styled as Smt. Lakshmi Devi and others .....Vs.... Awadhesh, Application preferred by the Respondent no. 2 to 4 allow the revision. It is further prayed that during the pendency of the revision the stay implementation and operation of the order dated 19.07.2024 passed by Additional Learned Principal Judge, Family Court no. 1st Unnao Case no. 398/2020, U/s 125 Cr. P.C styled as Smt. Lakshmi Devi and others .....Vs.... Awadhesh, application preferred by the Respondent no. 2 to 4 may be stayed in the interest of Justice." The instant revision has been preferred alongwith an application (Crl. Misc. Application No. 2 of 2025) seeking condonation of delay of about 280 days challenging the order dated 19.07.2024 passed by the 1st Additional Principal Judge, Family Court, Hardoi (in short "trial court") in Criminal Misc. Case No. 398/2020 (Smt. Lakshmi Devi and two minors vs. Awadhesh), under Section 125 Cr.P.C. The operative portion of the order dated 19.07.2024 reads as under:- " ययचच शचमतच लकमच ददवच कक ओर सद पसततत ययचचकय अनतररत धयरय-125 दणड पचकयय ससचहतय एकपकचय रप सद सवचकयर कक जयतच हह। चवपकच अवधदश कक आददचशत चकयय जयतय हह चक वह ययचच ससखयय-01 शचमतच लकमच ददवच कक मत०-2,000/- रपयद पचतमयह कक दर सद, ययचच ससखयय-02 रजत कक मत०-1,500/- रपयद पचतमयह कक दर सद एवस ययचच ससखयय-03 चशवम कक मत०-1,500/- रपयद पचतमयह कक दर सद कत ल मत०-5,000/- रपयद भरण- पकषण अदय करनय सतचनशशचत करद। उक भरण- पकषण कक धनरयचश ययचचकय पसततत करनद कद चदनयसक 07-07-2020 सद ददय हकरय। ययचचकय पसततत चकए जयनद कक चतथथ 07-07-2020 सद लदकर चनणरय कक चतथथ तक ददय भरण-पकषण कक धनरयचश कक चवपकच तचन मयह कद अनदर ययचचरण कक पदत करद एवस चनणरय कक चतथथ कद पशचयत सद ददय भरण- पकषण कक धनरयचश कक पतयदक मयह कक 10 तयरचख तक चवपकच दयरय ययचचरण कक पदत चकयय जयए।" To condone the delay of about 280 days, following averments have been made in the affidavit filed in support of the application seeking condonation of delay:- "2. That it is relevant to mentioned here that the delay occurred due to that the Revisionist has not been any information of order dated 19.07.2024, so this reason he does not file criminal revision within time that when touch in his counsel and not to aware about the proceeding of the case. 3. That due to not received any information of order dated 19.07.2024 Revisionist arrange money proper time but when deponent arrange money then he contacted his counsel and counsel 23.07.2024 then he came ask present revision is time barred." To the view of this Court, the aforesaid averments made in the affidavit filed in support of the application seeking condonation of delay are completely misconceived. Thus, the application (Crl. Misc. Application No. 2 of 2025) seeking condonation of delay in filing the instant revision is accordingly rejected. Consequently, the instant revision is also dismissed.
