The applicant has preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’). for grant of regular bail, as he has been arrested in connection with Crime No. 62/2025, registered at Police Station Civil Lines Raipur District – Raipur (CG) for the offences punishable under Sections 75(1)(iv), 79 of BNS. 2 2. The prosecution story in brief, is that the complainant made a complaint to the Police Station- Civil Line, Raipur to the effect that on 04.02.2025 at around 05:00 pm she was standing on the balcony of her hostel room, when a person namely Vicky Chaudhary stood in an empty plot in- front of her balcony and started dirty acts for making gestures for intercourse. He has done that act many times before her. On the basis of the above complaint a crime was registered against the applicant under Sections 75(1)(iv) of BNSS under Crime No.62/2025. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case. She also submits that the allegations are false and baseless and there is no material to connect the applicant with the crime in question. She further submits that the complainant herself had filed no objection application along with affidavit before learned trial Court and raised no objection for grant of bail to the present applicant. The applicant is in jail since 05.02.2025 and the trial is likely to take some time for its conclusion. Therefore, she prays for grant of bail to the applicant. 4. On the other hand, learned State counsel opposes the bail application and submits that the charge-sheet has been filed in the present case before the competent Court. 3 therefore, the applicant is not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case, nature & gravity of the offence, looking to the act of the applicant, as such, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. Accordingly, the bail application of applicant – Vicky Choudhari, involved in Crime No. 62/2025, registered at Police Station Civil Lines, District – Raipur (CG) for the offences punishable under Sections 75(1) (iv), 79 of the BNS, is rejected. 7. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 8. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith.
