Neutral Citation No. - 2025:AHC:29530 Court No. - 4 Case :- WRIT - A No. - 1481 of 2025 Petitioner :- Pradeep Kumar Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Anil Kumar,Ashok Kumar Upadhyay Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. 1. Heard learned counsel for parties. 2. By means of this petition filed under Article 226 of the Constitution, petitioner has questioned the order of suspension dated 26.12.2024. However, from the records it transpires that petitioner has also been served with the charge sheet on 26.12.2024 and, hence, the departmental enquiry is in motion. 3. In these circumstances, therefore, I decline to grant indulgence in the matter at this stage. However, it is provided that petitioner shall be submitting reply to the charge sheet, if not already submitted, within a period of three weeks from today. The departmental enquiry in the matter shall be concluded within two months of the submission of the reply by the petitioner to the charge sheet or in the event reply is already submitted from the date of production of certified copy of the order. Soon after the departmental enquiry is completed, disciplinary proceedings shall also be brought to its logical end, within a further period of one month in full compliance of the principles of natural justice. It is further clarified that the procedure to be followed in the matter of departmental enquiry and disciplinary proceedings shall be as per the rules and petitioner shall be permitted due participation. 4. During the period of enquiry petitioner shall be paid subsistence allowance and the same shall abide by the final outcome of disciplinary proceedings. It is further provided that in the event, despite due participation by the petitioner, the respondents are not able to conclude the disciplinary proceedings as directed hereinabove, the order of suspension dated 26.12.2024 shall stand revoked. 5. This petition, thus, stands disposed of accordingly. Order Date :- 3.3.2025 Nadeem Digitally signed by :- NADEEM AHMAD High Court of Judicature at Allahabad
