Neutral Citation No. - 2025:AHC:49810-DB Chief Justice's Court Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 251 of 2025 Petitioner :- Sukhveer Singh Respondent :- State of Uttar Pradesh and 4 others Counsel for Petitioner :- Kaushlendra Singh, Rashmi Singh Counsel for Respondent :- C.S.C., Seema Agarwal (S.C.), Sher Bahadur Singh Hon'ble Arun Bhansali,Chief Justice Hon'ble Kshitij Shailendra,J. 1. This petition, purportedly in public interest, has been filed by the petitioner seeking a direction to the District Magistrate to stop the construction of the Annapurna Bhawan in Gram Panchayat, Majra Vikrampur. 2. Submissions have been made that the shop where Annapurna Bhawan should have been constructed is at Gram Sabha Madhopur and not at Majra Vikrampur. It is claimed that in Madhopur, there are about 400 ration card holders, which aspect has not been taken into consideration and in case, the Bhawan is constructed at Vikrampur, the residents of Madhopur would suffer. 3. Instructions have been produced by learned Standing Counsel, inter alia, indicating that vide Gram Panchayat Resolution dated 18.11.2024, it was decided that as no Navin Parti/Banjar land was available in village Madhopur, Plot/Gata No. 198, situated at village-Vikrampur, Gram Panchayat,Madhopur is available for construction of the purposed Annapurna Bhawan, wherein the requisite construction is possible. In a meeting of the Land Management Committee dated 02.12.2024, under the Chairmanship of Gram Pradhan, proposal for construction of the Annapurna Bhawan was placed by the President, which was approved by the members of the Committee and that 70% construction of the Annapurna Bhawan is already over. Submissions have also been made that wife of the petitioner is running a fair price shop at Gram Panchayat-Madhopur and he has personal interest in the relief claimed and therefore, the same cannot be termed as a public interest litigation. 4. Learned counsel for the petitioner though does not dispute that the wife of the petitioner has a fair price shop at village Madhopur, however, submitted that on account of filing of the public interest litigation, her license has been suspended. 5. Having considered the submissions made in the petition and the instructions produced, it is apparent that while the petitioner has only made reference to some representations made questioning the selection of the land, the respondents have indicated reason for selection of the land on account of non-availability of land at village Madhopur. 6. In view of the above fact situation, we do not find any reason to entertain the present petition in the public interest, the same is, therefore, dismissed.
