Neutral Citation No. - 2025:AHC-LKO:43258 Court No. - 18 Case :- WRIT - A No. - 8235 of 2025 Petitioner :- Smt. Sonam Yadav Respondent :- State Of U.P. Thru. Prin. Secy. Child Development And Nutrition Deptt. Lko. And 5 Others Counsel for Petitioner :- Dheerendra Kr. Agnihotri Counsel for Respondent :- C.S.C. Hon'ble Manish Mathur,J.
1. Heard learned counsel for petitioner and learned State Counsel for opposite parties no. 1 to 5.
2. In view of order being passed, notice to opposite party no.6 stands dispensed with.
3. Petition has been filed challenging inquiry dated 07.05.2025 and 09.05.2025 pertaining to alleged improper selection of opposite party no.6, Smt. Meena Yadav W/o Anil Yadav on the post of Aganwadi Worker in respect of Village Panchayat Bhatpurwa, Pargana Maurawan, Tehsil Purwa, District Unnao.
4. It has been submitted that opposite party no.6 in fact comes from a wealthy family and has fraudulently obtained the Income Certificate indicated her to be below poverty line category.
5. However, from a perusal of documents on material on record, it is evident that Income Certificate is required to be issued by Tehsildar concerned whereas no application has been preferred by petitioner for cancellation of Income Certificate issued to opposite party no.6.
6. There does not appear to be any provision whereunder the validity of Income Certificate can be examined by an authority, which is undertaking proceedings for recruitment on the post of Aganwadi Worker. Since admittedly no application has been preferred by petitioner before the Tehisdar concerned for cancellation of Income Certificate, which is the basis for selection of opposite party no.6 on the post of Aganwadi Worker, no relief can be granted in the petition at this stage.
7. In view thereof, the petition fails and is dismissed. Parties to bear their own cost. Order Date :- 28.7.2025 Satish Digitally signed by :- SATISH KUMAR BHARATI High Court of Judicature at Allahabad, Lucknow Bench
