Learned counsel for the petitioner as well as learned A.G.A. for the State and perused the record. 2. This writ petition has been filed by the petitioner with following main prayer: "I. A suitable writ, order or direction in the nature of Certiorari quashing the impugned First Information Report dated 28.04.2025 lodged by the opp. party no.4 in case crime no. 0172 of 2025 under section 2 (b) (i), 3 of U.P. Gangster Act & Anti Social Activities (Prevention) Act 1986, at Police Station -Bhira, District Kheri, against the Petitioner, contained as Annexure No.-1 to this writ petition." 3. It has been submitted by learned counsel for the petitioner that there is complete non application of mind on the part of the approving authority. 4. It has also been submitted that the criminal proceedings in the predicate offence has been quashed by this Court. 5. Learned A.G.A. has produced before this Court instruction sent by Shri Gopal Narayan Singh, Incharge Inspector, Police Station Bheera, Lakhimpur Kheri, wherein it has been stated that after passing order dated 27.06.2025 in Criminal Misc. Writ Petition No.5658 of 2025, Final Report has been prepared on 24.07.2025 and submitted to the court concerned. The instructions are taken on record. 6.
