1. Vakalatnama' filed by Shri Mahesh Kumar Pathak, Advocate on behalf of respondent no.4 is taken on record. 2. Heard learned counsel for the petitioners as well as learned A.G.A. who appears on behalf of the State/Respondents, Shri Mahesh Kumar Pathak, learned counsel for respondent no.4 and perused the record. 3. This petition has been filed by the petitioners with following main prayers:-
"(1) Issue a writ, order or direction in the nature of Certiorari for quashing FIR /Crime No-687/2025 dated 17.07.25, U/S 108, 308(5), 351(3), 61(2) BNS Police Station-Kotwali, District-Barabanki, annexed as Annexure No-1 to this petition. (II) Issue a writ, order or direction in the nature of Mandamus commanding the Respondents, particularly Respondent No. 3, not to take any coercive or adverse action against the Petitioner pursuant to the impugned FIR/Crime No-687/2025 dated 17.07.25, U/S 108, 308(5), 351(3), 61(2) BNS Police Station-Kotwali, District-Barabanki, during the pendency of this writ petition annexed herewith as Annexure No-1 to this petition."
4. It is stated by learned counsel for the petitioners that the petitioners are completely innocent and have been falsely implicated in the impugned F.I.R. The case is that the petitioner no.1 was molested on 09.07.2025 and she made a complaint on 1090 portal against the deceased, on which police had taken action and called
father of the deceased and made a conciliation where parents of the deceased namely Sarvesh Kumar Verma and Sushma Verma had given a written undertaking before the police that their son will not chase or molest petitioner no. 1 in future, a copy of written undertaking dated 10.07.2025 has been filed as Annexure No.2 to the writ petition. However, parents of the deceased were annoyed with the deceased for the aforesaid reasons and they taunted him and abetted his suicide. Now the parents have lodged the impugned F.I.R. only to harass the petitioners and falsely implicate them. 5.
Learned counsel for respondent no.4 says that there is a video clip made by the deceased just before his suicide saying that the petitioners are responsible for his death as they have constantly harassed him by making false allegations and they have also taken money. 6. Learned A.G.A. has produced before this Court written instructions alongwith case diary sent by Shri Lalji Yadav, Sub Inspector, Police Station Kotwali Nagar, District Barabanki, wherein detailed reference of the contents of the such video clip made by the deceased just before his death has been made. The instructions are taken on record. 7. We have gone through the contents of impugned F.I.R., instructions including case diary and we find that a cognizable office is made out. This Court does not find any good ground to interfere in the impugned F.I.R.
8. Accordingly, writ petition is dismissed. . (Brij Raj Singh,J.) (Sangeeta Chandra,J.) Order Date :- 29.7.2025 Anupam S/- Digitally signed by :- ANUPAM SINGH PATEL High Court of Judicature at Allahabad, Lucknow Bench
