The present second appeal is filed by legal heirs of Ram Chandra who was plaintiff no.11/1. 2. It is evident from the record that the Registry has reported delay of 6,790 days. It is also evident that suit was filed by predecessor of the appellant along with ten other persons, which was dismissed on 06.08.2003. Thereafter, an appeal was preferred by the plaintiff, which was registered as Civil Appeal No. 35 of 2003 and the same was also dismissed vide judgment and order dated 25.09.2004. 3. At this stage, learned counsel for the appellant does not want to press the instant appeal and prays that he may be permitted to withdraw the same. 4.
