Heard learned counsel for the applicant and learned Additional Government Advocate for the State as well as perused the record. It is further submitted that apart from the aforementioned cases, the applicant has criminal history of two more cases in which also he has been granted bail. Copies of the bail orders have been annexed as Annexure-5 to the bail application respectively. The applicant is languishing in jail since 4.4.2023. It is further submitted that co-accused Ranveer Pratap @ Raja Babu has been granted bail by this Court vide order dated 7.7.2025 passed in Criminal Misc. Bail Application No.6259 of 2025. He seeks parity with the bail order of the said co-accused. It is also submitted that the applicant is ready to furnish an undertaking in terms of requirement of Section 19(4)(b) of U.P. Gangsters & Anti Social Activities (Prevention) Act, 1986. It is further submitted that there is no possibility of the applicant of fleeing away from judicial custody or tampering with the witnesses. In case the applicant is enlarged on bail, he shall not misuse the liberty of bail. Learned A.G.A. opposed the prayer for bail but could not dispute the aforesaid facts as argued by the learned counsel for the applicant. Considering the facts that the applicant is in jail since 4.4.2023, in the gang chart two cases shown against him in which he has already been granted bail, the applicant seeks parity with the bail order of co-accused who has been granted bail by this court, and without expressing any opinion on the merits of the case, I am of the view that it is a fit case for granting bail to the applicant. Accordingly, the application is allowed. Let the applicant Jitendra Singh @ Badakkey Singh involved in the aforesaid case crime number be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions which are being imposed in the interest of justice:- (i) The applicant will not tamper with the evidence during the trial.
