Shri Ravi Srivastava, learned A.G.A. raised a preliminary objection that this appeal is not maintainable because the First Information Report has been lodged in pursuance of the impugned order vide FIR No.0357 at Police Station-Bhinga, District-Shrawasti, a copy of which has been placed before the court, which is taken on record. Shri Arvind Kumar Tiwari, learned counsel for the appellants submits that the appeal may be dismissed as not pressed with liberty to the appellants to avail appropriate remedy. To which there is no objection to learned A.G.A.
