Neutral Citation No. - 2025:AHC-LKO:44705-DB Court No. - 2 Case :- WRIT - C No. - 7127 of 2025 Petitioner :- Ruby Yadav Respondent :- State Of U.P. Thru. Addl. Chief Secy. Deptt. Of Revenue Lko. And 3 Others Counsel for Petitioner :- Santosh Kr. Yadav Warsi,Deepti Singh,Dheeraj Kumar Yadav,Rajjoo Singh,Shekhar Singh Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Manish Kumar,J. Heard Shri Santosh Kr. Yadav Warsi along with Shri Dheeraj Kumar Yadav, learned counsel for the petitioner and learned Additional Chief Standing Counsel for the State. Even after repeated queries as to what is proof that the father of opposite party no. 4 is working as Pump Operator in a Government department none could be shown nor any other proof could be shown to enable the Court to form a prima facie opinion for interference in a matter where the Income Certificate of opposite party no. 4 has been challenged by the petitioner. We, therefore, find no reason to exercise our extraordinary jurisdiction under Article 226 of the Constitution of India, however, we leave it open for the petitioner to approach the concerned authorities, if there is proof in support of her claim unless on an application already submitted by the petitioner an inquiry has been got conducted, as informed by the learned Additional Chief Standing Counsel for the State in which the Income Certificate of opposite party no. 4 has been found to be valid. With the aforesaid observations/directions, the writ petition is disposed of. . (Manish Kumar,J.) (Rajan Roy,J.) Order Date :- 1.8.2025 R.K.P.
