Chief Secy. Home Lko. And Others Counsel for Petitioner :- Jayant Pratap Singh,Tribhuwan Agnihotri Counsel for Respondent :- G.A. Hon'ble Mrs. Sangeeta Chandra,J. Hon'ble Brij Raj Singh,J. 1.Sri Sachida Nand Tiwari, Advocate has filed his Vakalatnama today in Court on behalf of opposite party No.3, which is taken on record. 2. Heard learned counsel for the petitioners as well as learned counsel for the opposite party No. 3 and learned A.G.A., who appears for the State. 3. This writ petition has been filed with the following relief(s):
"Issue a Writ, order or direction in the nature of certiorari thereby quashing the First Information Report dated 14.07.2025 lodged against the petitioner as F.I.R. No. 0283 of 2025, under Sections 115(2), 352, 108 & 77 BNS and 66E IT ACT, Police Station Beniganj, District- Hardoi, so far as it relates to the petitioner(as contained in Annexure No. 1)."
4. It has been submitted by the learned counsel for the petitioners that the petitioners are completely innocent and has been falsely implicated in the impugned F.I.R., in respect of an incident which took place on 12.07.2025. The informant is the father of the deceased and he alleged that the co-accused Pratham, clicked the picture of this daughter while she was taking bath and changing her clothes which he forwarded to his uncle, namely, Satyam and the same was forwarded on the mobile phone of informant's son. When the daughter of the informant got to know about the video being circulated and being made viral, then the informant's wife took her daughter to Pratham's house to make a complaint. It appears that the allegation against the petitioners is that they being the father, mother and maternal aunt have abused and assaulted them. The informant's daughter was emotionally disturbed and she committed suicide on 12.07.2025. 5. It has been submitted by learned counsel for the petitioners that the F.I.R. is an after thought only to extract money from the
petitioners. There are other allegations made in the writ petition, which we do not wish to reproduce here in this order. 6. We have gone through the impugned F.I.R. and are extremely disturb with the contents thereof.
We do no wish to interfere, as cognizable offence is made out. 7. The petition is dismissed. (Brij Raj Singh,J.) (Sangeeta Chandra,J.) Order Date :- 28.7.2025 Arvind Digitally signed by :- ARVIND KUMAR SRIVASTAVA High Court of Judicature at Allahabad, Lucknow Bench
