This is the First bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023, for grant of regular bail to the applicant who has been arrested in connection with Crime No. 32/2025 registered at Police Station– Komakhan, District – Mahasamund (C.G.), for the offence punishable under Section 20(b) of the Narcotic Drugs and Psychotropic Substances Act,
1985. 3. The brief facts of the case are that on 01/03/2025 the concerned police of police station Komakhan received secret information during the course of village Patrolling through informant that the applicant is having contraband Ganja for the purpose of sale. On the basis of such information the concerned police reached on spot and after search enquiry has been started by the police of police station Komakhan thereafter the police team reached on spot wherein one persons with white colour of plastic bag sitting and for waiting of Train near water pump, Railway station Komakhan wherein one person having 02 white colour of plastic bag and after askance his name told Anand Kumar Singh. Before some time being Election of Chhattisgarh he was came in his village. After searching by the police team and found two white clolour of Plastic bag inside having contraband Ganja total weight 21 Kilogram total amounting of Rs. 3,15,000/- has been seized from the possession of applicant.
Thereafter the concerned police of police station Komakhan investigated the matter and registered the crime for an
3 / 4 offence punishable under section 20(B) of Narcotic Drugs & Psychotropic Substances Act. 4. Learned counsel for the applicant submits that the present applicant has been falsely implicated in this case. He further submits that quantity seized from the applicant is much lesser than the commercial quantity. He submits that applicant has no previous criminal antecedents. He submits that the present applicant has been in jail since 01.03.2025 and conclusion of the trial may take some time, therefore, he prays for grant of regular bail to the present applicant. 5. On the other hand, learned State counsel opposes the bail application of the present applicant and submits that the quantity of contraband article i.e. 100 Kgs of Ganja has been seized from the possession of the applicant, which shows that it is an organized crime, therefore, the applicant is not entitled to be released on bail. 6. I have heard learned counsel appearing for the parties and perused the case diary. 7. From perusal of the case diary, it transpires that the article which has been seized from the possession of the applicant is much above the commercial quantity, further the applicant has failed to give explanation for the same and it cannot be a case of false implication, the trial is in progress. 8. Accordingly, the bail application of the applicant – Anand Kumar Singh, involved in Crime No. 32/2025 registered at Police Station–
4 / 4 Komakhan, District – Mahasamund (C.G.), for the offence punishable under Section 20(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985, is rejected. 9. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 10. OfÏce is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. -
