PUBLIC PROSECUTOR The Court made the following Order: Heard learned counsel for the petitioners and learned Assistant Public Prosecutor appearing for the State. 2. The learned counsel for the petitioners submits that the petitioners are arrayed as accused Nos.2 to 6 in Crime No.37 of 2025 on the file of Chintalapudi Police Station, Chintalapudi Mandal, Eluru district, for alleged offences under Sections 69, 318(4), 351(2) read with 3(5) of BNS. It is submitted that the allegation under Section 69 of BNS would not be applicable to the petitioners and the police have also issued notice under Section 35(3) 2 of BNSS to few petitioners. It is submitted that the petitioners 4 and 5 are senior citizens and are not connected with the alleged offence. 3. Considering the submissions and considering the nature of allegations, the Station House Officer, Chintalapudi Police Station, Chintalapudi Mandal, Eluru district is directed to complete the investigation by following the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, “BNSS”) in so far as the petitioners are concerned. 4. With these observations, the Criminal Petition is disposed of. 5.
