Neutral Citation No. - 2025:AHC-LKO:43062 Court No. - 14 Case :- CRIMINAL MISC. ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 914 of 2025 Applicant :- Aditya Singh @ Rajvendra Pratap Singh Opposite Party :- State Of U.P. Thru. Addl. Chief Secy. Home Deptt. Lko. And Another Counsel for Applicant :- Prem Prakash Singh,Vivek Kumar Singh Counsel for Opposite Party :- G.A. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel the applicant and learned A.G.A. for the State. The present application under Section 438 Cr.P.C./482 B.N.S.S. has been filed seeking anticipatory bail in FIR/Case Crime No. 80 of 2025, under Sections 309(4), 317(2) of B.N.S., P.S. Bhiti, District- Ambedkarnagar.
Learned counsel for the applicant submits that the applicant is innocent and he has been falsely implicated in the present case. Learned A.G.A. has opposed the anticipatory bail application and submitted that the investigation in this case is going on and custodial interrogation in this case is required. Thus, no case for anticipatory bail is made out. Perused the record. A perusal of the record shows that the looted motorcycle and mobile have been recovered from the co-accused Gopal Giri, Kunal @ Uday Sharma and Aman Goswami. One Vivo mobile is said to have been recovered from the possession of the applicant Aditya Singh. Thus, prima facie, the complicity of the applicant is evident. Hence, it cannot be said that the applicant has been falsely implicated, particularly in view of his previous criminal involvement. In view of the above, no ground for grant of anticipatory bail is made out. Accordingly, the anticipatory bail application is rejected.
