Neutral Citation No. - 2025:AHC-LKO:44069 Court No. - 14 Case :- CRIMINAL MISC. ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 925 of 2025 Applicant :- Shushil Kumar Mishra Opposite Party :- State Of U.P. Thru. Prin. Secy. Home Deptt. Lko And Another Counsel for Applicant :- Manoj Kumar Mishra,Ajay Kumar Verma,Shubham Kumar Verma Counsel for Opposite Party :- G.A.,Gaurav Mani Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the applicant and learned A.G.A. for the State. Perused the record. The accused-applicant seeks anticipatory bail in FIR No. 0695 of 2024, under Sections 406, 420, 467, 468, and 471 of the Indian Penal Code, Police Station Dewa, District Barabanki. Perusal of the record shows that the applicant is stated to be the Director of a Multi-State Cooperative Housing Society Limited. It is evident from the record that the plotting and development activities were undertaken by the applicant and co-accused persons of the said company without any requisite approval from the competent authority, namely the Lucknow Development Authority. Moreover, the applicant and his company admittedly do not possess any license or authorization from the Reserve Bank of India (RBI) to operate or run any financial activities, thereby violating regulatory norms. The allegation is that a sum of Rs.1.45 crore, invested by various investors, has been misappropriated by the applicant and others. The applicant has also been shown to have a criminal history involving several cases of similar nature about ten such cases, all registered in the same year. The allegation, therefore, does not appear to be a case of false implication. In light of the serious nature of the allegations involving economic offences, forgery, and large-scale fraud with multiple victims, coupled with the applicant’s criminal antecedents, no ground for
grant of anticipatory bail is made out. Accordingly, the anticipatory bail application is rejected. Order Date :- 30.7.2025 Madhu D.R/P.S Digitally signed by :- MADHU KUMARI High Court of Judicature at Allahabad, Lucknow Bench
