No. - 815 of 2025 Applicant :- Ram Chandra Rana (In Aadhar Card Ram Chandra) Opposite Party :- State Of U.P. Thru. Prin. Secy. Home Lko. And 2 Others Counsel for Applicant :- Aman Kumar Shrivastav Counsel for Opposite Party :- G.A. Hon'ble Karunesh Singh Pawar,J. The present anticipatory bail application has been filed seeking anticipatory bail in Range Case No. 04/2015-16, u/s 2, 27, 31, 35(6), 52, 51(1), Wild Life Protection Act and section 26, 41, 42 Indian Forest Act, Range Gauriphanta, District Lakhimpur Kheri Heard learned counsel for the applicant and learned A.G.A. for the State. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated. He has explained 22 criminal cases against him in paragraph 25 of the bail application. Learned A.G.A. while opposing the bail has submitted that the applicant is involved in 22 complaint cases of a similar nature. It is further submitted that the applicant has not appeared before the trial court in any of those cases and is absconding since 2012. Considering the applicant’s long and chequered criminal history involving offences of identical nature, his continuous abscondence for over ten years, and his failure to appear before the court in any of the cases, no case for anticipatory bail is made out. At this stage, learned counsel for the applicant seeks to withdraw the anticipatory bail application with liberty to file a regular bail application, which may be considered in light of the law laid down by the Hon’ble Supreme Court in Satender Kumar Antil vs. Central Bureau of Investigation and Another, Special Leave to Appeal (Cri) No. 5191 of 2021. In view of the above, the present anticipatory bail application is dismissed as not pressed. It is, however, provided that if the applicant files a regular bail application within ten days from the date of receipt of a certified copy of this order, the same shall be considered in accordance with the law laid down by the Hon’ble Supreme Court in Satender Kumar Antil (supra) by order dated 07.10.2021.
