Neutral Citation No. - 2025:AHC-LKO:43619-DB Court No. - 2 Case :- WRIT - C No. - 7079 of 2025 Petitioner :- Awadh Naresh Yadav And 3 Others Respondent :- State Of U.P. Thru. Prin. Secy. Revenue Deptt. Lko. And 5 Others Counsel for Petitioner :- Ghanshyam Verma Counsel for Respondent :- C.S.C.,Prashant Kumar Srivastava,Sarvesh Kumar Dubey Hon'ble Rajan Roy,J. Hon'ble Saurabh Lavania,J. Heard Ms. Deepali Verma holding brief of Shri Ghanshyam Verma, learned counsel for the petitioner, Ms. Akansha Dubey, learned Additional Chief Standing Counsel for the State and Shri Prashant Kumar Srivastava, learned counsel for the Bank. Although, Ms. Akansha Dubey, learned Additional Chief Standing Counsel has instructions to the effect that Bank concerned has been informed by the District Magistrate, Sultanpur for defreezing the account of the petitioner which was ordered to be freezed earlier and a communication dated 20.07.2025 has been sent to the opposite party no. 6- Bank, but, learned counsel for the Bank Shri Prashant Kumar Srivastava says that they have not received any such communication. The District Magistrate, Sultanpur would be better advised to ensure that the communications are served upon the concerned Bank, as, in some other cases also similar statement has been made by the learned counsel for the Bank. It is made clear that if this Court is burdened with any further case wherein stand of the Bank is that the alleged communication by the District Magistrate, Sultanpur has not been received by the Bank and it is proved to be so, then, consequences would be serious because we are disposing of the writ petitions on the instructions provided by the District Magistrate, Sultanpur and if the same are found to be incorrect, leading to further litigation, then, cost etc. will have to be imposed. In this case the communication should be re-sent to the Bank and its service should be ensured within a period of one week. The Bank shall do the needful to defreeze the account accordingly. Ms. Akansha Dubey, learned Additional Chief Standing Counsel for the State shall communicate our order to the District Magistrate, Sultanpur. With the aforesaid observations/directions, the writ petition is disposed of. . (Saurabh Lavania,J.) (Rajan Roy,J.) Order Date :- 29.7.2025 R.K.P.
