Mr. Faizan Ali, Advocate holding brief of Mr. Munish Bhardwaj, learned counsel for the petitioner. 2. Mr. Suman Negi, learned counsel for the respondent. 3. Petitioner took loan of ₹47,500/- from Uttarakhand Alpsankhyak KalyanTatha Waqf Vikas Nigam (in short ‘Nigam’). Since petitioner defaulted in repayment of loan, therefore, demand notice was issued to him by District Manager of the Nigam on 19.12.2024, whereby petitioner was asked to deposit ₹88,506/-, within five days. Feeling aggrieved by the demand notice, petitioner has approached this Court. 4. Mr. Suman Negi, learned counsel appearing for the Nigam submits that a recovery citation has also been issued against the petitioner for recovery of outstanding dues. 5. Learned counsel for the petitioner submits that petitioner is ready and willing to repay the entire loan for which petitioner needs four months time. 6. Learned counsel for the respondent- Nigam submits that if petitioner deposits ₹20,000/- within two weeks from today, then he may be permitted to repay the remaining amount in four equal monthly instalments. 2025:UHC:9491 7. Having regard to the willingness shown by the petitioner, the writ petition is disposed of with the following directions:- (i) Petitioner shall deposit ₹20,000/- with the respondent - Nigam within two weeks from today. (ii) The remaining amount shall be deposited by the petitioner in four equal monthly instalments; the amount whereof shall be fixed by the Nigam. (iii) The last instalment shall also carry interest & other charges, if any. (iv) In case of any default by the petitioner, he shall not be entitled to protection of this order and respondent/Nigam will be free to proceed against him, in accordance with law.
