The present appeal has been filed under Section 14-A (2) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 read with Section 482 of BNSS against the order dated 08.07.2025, passed by Special Judge, SC/ST Act, Lucknow in Anticipatory Bail Application No.4227 of 2025, arising out of Case Crime No.0239 of 2023, under Sections - 354, 323, 504, 506 IPC and Section 3(1)(da), 3(1) (dha) of SC/ST Act, Police Station - Ashiyana, District - Lucknow by means of which anticipatory bail application of the appellants has been rejected. Considered the punishment provided for the offence(s), as indicated, under Sections 354, 323, 504, 506 I.P.C. and Section 3 (1) (da), 3(1)(dha) of SC/ST Act as also the observations made by the Hon'ble Apex Court in the case of Satender Kumar Antil versus Central Bureau of Investigation and another, (2022) 10 SCC 51. Upon due consideration, this Court finds that the present case would fall under the category "A" of the above referred judgment. Accordingly, this criminal appeal is disposed of with the following terms : (i) The appellants shall appear before the court concerned by preferring appropriate application(s). (ii) The court concerned shall adhere to the verdict of the Hon'ble Apex Court, mentioned above, in its letter and spirit and pass appropriate orders.
