The present petition under Section 528 of the BNSS seeks the following prayers: “a. Quash the FIR bearing no. 24 of 2025 register at police station Chittaranjan Park, New Delhi against the petitioner under Section 420 IPC and all proceedings arising therefrom and/or b. Quash and set aside the order dated 18.03.2025 passed by Court of Ld. JMFC-04, South East, Saket Courts, Delhi in FIR 24/2025 and/or” This is a digitally signed order. At the very outset, learned counsel appearing on behalf of the petitioner submits that he has no dispute with regard to the fact that the matter has been settled with the complainant for a sum of Rs. 85 lakhs and he is ready and willing to go ahead with the undertaking given by him before the learned Trial Court with respect to the payments as recorded in the order dated 18.03.2025. It is, however, submitted that the complainant should also hand over to the petitioner the invoices of the amount so received. 5. Learned counsel appearing on behalf of the complainant submits that the latter is ready and willing to give the invoices for the sum of Rs. 85 lakhs i.e. the settled amount. As per the settlement, out of settlement amount of Rs. 85 lakhs, the petitioner has already paid the sum of Rs. 10 lakhs and as per schedule he has to deposit another sum of Rs. 35 lakhs on 14th April, 2025 and the next instalment to be paid on 27th June, 2025 of Rs. 40 lakhs. 6. Learned counsel for the complainant submits that the latter shall give the invoices to the tune of Rs. 45 lakhs to the petitioner on 14th April, 2025 and thereafter, the invoices of Rs. 40 lakhs to the petitioner on 27th June, 2025. Invoices will be with respect to jewellery articles. 7. In view of the above, learned counsel for the petitioner, without prejudice to the rights and contentions, seeks leave to withdraw the present petition. 8. Leave granted. 9. The present petition is dismissed as withdrawn and disposed of accordingly. 10. It is pointed out that as per the order dated 18th March, 2025, the applicant was directed to surrender before the Court/Jail Authorities on 14th April, 2025.
