Learned A.G.A. raised a preliminary objection that this appeal has been filed arraying Bhallu Rawat as respondent no.3 and the compromise deed also is in the name of Bhallu, whereas the name of complainant is Bhullu, which is not disputed by learned counsel for respondent no.3. In view of above, learned counsel for the appellant submits that the appeal may be dismissed as not pressed with liberty to file a fresh after proper compromise with correct description of parties. To which there is no objection by the other side. In view above the application is dismissed as not pressed with the liberty as aforesaid. As prayed by learned counsel for the applicants office is directed to return the original compromise annexed with the application and the certified copies filed alongwith the application to learned counsel for the applicants after keeping photocopies of the same on record in accordance with law. . . .. ....................................
