---- 06/21.08.2025 Heard learned counsel appearing for the petitioner as well as the learned counsel appearing for the State.
2. The petitioner is apprehending his arrest in connection with Chiniya P.S. Case No.08 of 2025 for the alleged offences registered under Sections 303(2) and 317(5) of Bharatiya Nyaya Sanhita, 2023 and Section 30(ii) of Coal Mines Act, pending in the Court of learned Judicial Magistrate, 1st Class, Garhwa.

Learned counsel appearing for the petitioner submits that the allegations are made that on three hywas coal was loaded to the tune of 40 M.T. on the valid documents which has been considered by learned Sessions Judge and in view of that two of the owners have been granted anticipatory bail by learned Sessions Judge by order dated 06.05.2025. He submits that the anticipatory bail of the petitioner has been rejected only on the ground that the petitioner was also found to be the owner of Fronx Sigma Four

Wheeler vehicle and he has fled away from the place.

Learned counsel appearing for the State opposes the prayer and submits that the petitioner has fled away from the place.

Considering that the notice under Section 35(3) of Bharatiya Nagarik Suraksha Sanhita, 2023 was issued and all the relevant documents have been submitted in that view of the matter the petitioner is directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
