THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA ...PETITIONER ...RESPONDENT(S) VENNA HEMANTH KUMAR(CENTRAL GOVERNMENT COUNSEL) under Article 226 of the Constitution of rdrespondent 227/153/2004/02 dated which is modified to that of compulsory retirement from service 227/Appeal- respondent which is further confirmed 3/19Pt, dated arbitrary and violative of Article 14 and 16 of
Constitution of India and consequently direct the respondents to reinstated the petitioner into service with all consequential benefits like back wages, Seniority, Pay Fixation as per the Pay Revision Scales -2006 Promotion etc ., and pass such other orders”. 2. Heard Sri J.M.Naidu, learned counsel for the petitioner and Sri Venna Hemanth Kumar, learned Standing Counsel for the respondents 1 to 3. 3.
Learned counsel for the petitioner would submit that initially the Writ Petition is filed challenging the impugned orders issued by 2nd respondent removing the petitioner from service, which is modified later as compulsory retirement through Force order dated 14.12.2004. Later, the petitioner filed several Revision Petitions and by virtue of order vide WP.No.19349 of 2017, the Revision Petitions were disposed of by the respondent No.1 vide order dated 02.06.2017 confirming the Force order dated 14.12.2004. 4. Learned counsel would further submit that now the petitioner is retired, a direction may be given to the respondent authorities to consider the case of the petitioner by granting revised pension as per his entitlement. 5. Learned Standing Counsel for the respondents 1 to 3 would submit that the petition may be disposed of directing the respondents to consider the case of the petitioner to the extent of fixing the pension as per the rules and law. 6. Considering the submissions made, the Writ Petition is disposed of. However, the respondent No.3 is directed to fix the pension of the petitioner
as per pay revision, according to governing rules and law, within two (02) months from the date of receipt of a copy of this order. 7.
