GP FOR HIGHER EDUCATION The Court made the following: 4 HON’BLE SRI JUSTICE NYAPATHY VIJAY W.P.No.24944 of 2025 O R DE R: This writ petition is filed declaring the action of Respondents in not paying Rs.9.50 lakhs in respect of works executed for providing additional infrastructure facilities to Government Junior College, Nandyal, Kurnool District. 2. Respondent No.2 had issued a tender notice NIT No.35/SSA/CW/2018-19 dated 26.06.2018 for providing additional infrastructure facilities to Government Junior College at Nandyal and the total estimated cost was Rs.65 lakhs. In response to the tender notice, the Petitioner was declared to be the highest bidder vide Memo No.840/SSA/CW/NABARD-RIDF- 23/2018-19 dated 26.09.2018. 3. As the sanctioned amount of Rs.65 lakhs was not sufficient to complete the works in all aspects, the Petitioner incurred an additional expenditure of Rs.9.5 lakhs and works in terms of the tender were completed and handed over to the concerned authorities. The Petitioner was thereafter applied for sanction of additional amount of Rs.9.5 lakhs and as the same is not being 5 paid, the present writ petition is filed. 4. Learned standing counsel, on instructions, passed on signed instructions of Executive Engineer, A.P.Samagra Shiksha, Kurnool, wherein it is stated that the Petitioner had completed the works in all aspects. As regards the additional amount claimed by the Petitioner, it is stated that Additional Project Coordinator, APSS, Kurnool has addressed a letter on 19.01.2022 to the Commissioner of Intermediate Education to include the items in Phase-II Mana Badi Nadu Nedu Programme for clearing the bills. It is further stated that Commissioner of Intermediate Education vide Memo No.Acad.II-1/655897/RIDF-23/2018 dated 11.02.2022 called for a detailed report from Vocational Educational Officer, Kurnool for verifying the works for sanction of additional amount. Pursuant thereto, Vocational Educational Officer submitted a detailed report vide Lr.Rc.No.A/Spl/RIDF-23/2018-19 dated 26.04.2022 and 04.01.2023 and the issue is pending before the Commissioner of Intermediate Education, A.P., Vijayawada for giving additional administrative sanction. 5. Considering that the report with regard to Additional works undertaken by the Petitioner was submitted on 26.04.2022 and 6 04.01.2023, the writ petition is disposed of with the following directions: (i) Respondent No.6-Commissioner of Intermediate Education is directed to examine the report of Vocational Educational Officer, Kurnool dated 26.04.2022 and 04.01.2023 regarding the claim of the Petitioner for sanction of the additional amount of Rs.9.5 lakhs incurred for the additional works and pass appropriate orders. (ii) In the event, the Petitioner is declared to be entitled to the amounts, the same shall be disbursed within a period of four (4) weeks thereafter. (iii) This entire exercise shall be completed within a period of three (3) months from the date of receipt of a copy of this order. (iv) No order as to costs.
