Heard learned counsel for the appellants and learned AGA for the State. The present criminal appeal under Section 14 A(1) of S.C./S.T. (Prevention of Atrocities)Act,1989 has been filed against the impugned order dated 15.04.2019 passed by learned Additional Session Judge(Second)/Special Judge SC/ST Act, Lucknow in Special Trial No.149/2019(State versus Angraj Yadav and others), under Sections 323, 325, 504, 506 IPC and Section 3(1) (r)(s) SC/ST Act, Police Station Itaunja, District Lucknow. Learned counsel for the applicants, after arguing at some length, submits that he does not want to press this appeal and submits that the appeal may be dismissed as not pressed so that the appellants may appear before the concerned court and seek the benefit of the order of Hon'ble Supreme Court passed in the case of Satendra Kumar Antill Vs. Central Bureau of Investigation and Others, 2022 SCC OnLine SC 825. To which there is no objection by learned AGA. In view of above, this appeal is dismissed as not pressed with liberty as aforesaid. It is needless to say that in case the appellants appear before the concerned court within a period of ten days from today and claim the benefit of the judgment passed in Satendra Kumar Antill Vs. Central Bureau of Investigation and Others, 2022 SCC OnLine SC 825, the concerned court is to consider the same in accordance with law.
