Learned A.G.A. raised a preliminary objection that the complainant has also made allegations of beating and the summoning order under Section 379, 323, 504 506 IPC has been issued against the applicants, therefore, without compromise with him and making him a party the proceedings cannot be quashed, Shri Shiv Shankar Mishra, learned counsel for the applicant submits that the application may be dismissed as not pressed with liberty file a fresh after impleading the complainant and appropriate pleadings. To which there is no objection by learned A.G.A. In view of above, the application is dismissed as not pressed with the liberty as aforesaid.
