Petitioner took a loan in the form of Cash Credit Limit from District Cooperative Bank, Evening Branch, Pithoragarh in the year 2009. Since there was some default on the part of the petitioner, therefore, the bank has issued a recovery certificate, pursuant to which Tehsildar, Pithoragarh has issued citation for recovery of `6,12,796/- + interest and other expenses. Thus, feeling aggrieved, petitioner has approached this Court. 5. Learned counsel for the petitioner submits that due to some family problems, petitioner could not repay the loan in time. He submits that, if given an opportunity, petitioner will clear off all the pending dues. He submits that petitioner be permitted to repay the outstanding dues in six bimonthly installments. 6. Mr. Anil K. Bisht, learned counsel 2025:UHC:9932 appearing for the bank, was granted time to get instructions. Today, on instructions, he submits that bank has no objection if petitioner is permitted to repay the outstanding dues in six bimonthly installments, provided petitioner makes upfront deposit of ₹1,00,000/- within six weeks to show his bona fide. 7. In such view of the matter, the writ petition is disposed of with the following directions:- i. Petitioner shall deposit `1,00,000/- with the concerned Branch of the bank on or before 31.12.2025. ii. Subject to fulfilment of the aforesaid condition, petitioner shall be permitted to deposit the remaining amount in six equal bimonthly installments. The last installment shall carry the component of interest and other expenses also. iii. Subject to fulfilment of the aforesaid conditions, no coercive step shall be taken against the petitioner pursuant to impugned recovery citation. In case of any default on the part of the petitioner, the respondents shall be at liberty to proceed against petitioner, as per law.
