( 2025:JHHC:14300 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A.No. 2915 of 2025 ----- Mahadev Shinde, aged about 37 years, son of Rohidas Shinde, Resident of Wangital, Near Airtel Tower, Post Wangital, Police Station Mandrup, District Solapur, State Maharashtra ……… Petitioner -Versus- The State of Jharkhand ……… Opp. Party ----- CORAM : HON’BLE MR. JUSTICE RAJESH SHANKAR ----- For the Petitioner : Mr. Vikash Kumar, Advocate For the State : Mr. Sanat Kumar Jha, A.P.P. ----- Order No.2 Date: 29.05.2025 1. The petitioner apprehending his arrest in connection with Seraikella P.S. Case No. 150 of 2024, for the offences punishable under Sections 316 (3)/ 318 (4)/ 338/336 (3)/ 340 (2) of the B.N.S., 2023, pending in the Court of learned Chief Judicial Magistrate, Seraikella, has prayed for grant of anticipatory bail. 2. Learned Counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F.I.R. The petitioner is neither the driver nor the owner of the truck. He has been roped in the present case on the alleged confessional statement of co-accused- Chandrakant Dhanappa Dhansheti who was the driver of the truck in question and was involved in fraudulent loading of 40 tons of rice from the factory premises of the informant. The petitioner has no idea as to how the said truck was found involved in alleged offence. Otherwise also, the driver of the said truck was in control of the same at the time of alleged occurrence. Moreover, 2 after seizure of the vehicle, the rice has already been released in favour of the informant as has been stated in paragraph-11 of the present anticipatory bail application. The petitioner has no criminal antecedent as has been stated in paragraph-14 of the present anticipatory bail application. He, however, undertakes to co-operate in the investigation. Hence, he may be given the privilege of anticipatory bail. 3. Learned A.P.P. opposes the petitioner’s prayer for grant of anticipatory bail. 4. Having heard learned counsel for the parties and considering the material available on record, I am inclined to enlarge the petitioner on anticipatory bail. 5. Accordingly, the petitioner, above named, in the event of his arrest or surrender before the court below within three weeks from today, shall be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate at Seraikella in connection with Seraikella P.S. Case No. 150 of 2024, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Rajesh Shankar, J.) P.K.S.
