Hon'ble Karunesh Singh Pawar,J. 1.Heard learned counsel for the applicants as well as learned Additional Government Advocate for State. 2.The present application has been filed seeking anticipatory bail in Range Case No.03 of 2013-14 under sections 9, 27, 31, 35(6), 52, 51(1), (1-C) of Wild Life Protection Act, 26 of Indian Forest Act, Range, Bankati, district Lakhimpur Kheri. 3.Learned A.G.A. submits that the offence is punishable upto maximum period of seven years. In view of the judgment in Satender Kumar Antil versus Central Bureau of Investigation and another Special Leave to Appeal (Cri)No.5191 of 2021, there is no apprehension of arrest. 4.A perusal of the record shows that in the prosecution case, it is alleged that the accused persons were found coming into jungle on 55 dunlopes (4-wheel vehicles). Total 245 lot of trees such as Saal, Asna, Jamun etc were cut down. 5.In view of the above facts, it does not appear to be a case of false implication. Even otherwise, there is no apprehension of arrest. No case for bail is made out. 6.The anticipatory bail is rejected. However, it is provided that in case the applicants file a regular bail application within two weeks from today, the same be decided expeditiously, strictly in view of the law laid down by Supreme Court in the case of Satender Kumar Antil versus Central Bureau of Investigation and another Special Leave to Appeal (Cri)No.5191 of 2021.
