N CRIMINAL PETITION No.4234 OF 2025 ORDER : 1. The petitioner is arraigned as accused No.4 in crime No.48 of 2025 on the file of Adoni I Town Police Station, Kurnool. The petitioner is facing allegations under Section 318(4), 340(1), 335, 316 (5) and Section 61(2) read with 3(5) of BNSS. 2. Learned counsel appearing for the petitioner submits that the petitioner is falsely implicated in a complaint alleging various offences and that the petitioner allegedly misused his office as the CEO of Sri Mahayogi Lakshmamma Cooperative Bank Limited and disbursed loans basing on fabricated documents. It is alleged that the bank suffered a loss of Rs.3,24,00,000/-. 3. Learned counsel appearing for the petitioner submits that the petitioner only discharged his duty as CEO and also took necessary steps for recovery when the loan accounts were declared as NPA. 4. It is submitted that basing on the rumors that the documents were not genuine, the complaint was filed. It is submitted that the complaint could not have filed on presumptions, as such seeks for bail before arrest. 5. Learned counsel appearing for the 2nd respondent submits that there are several documents which are linking up the commission -3- of offence by the accused including the petitioner. It is submitted that loans were sanctioned without any approval. It is also submitted that some loans were disbursed in favour of dead persons. 6. It is submitted that there are several documents which the police would have to peruse for punishing the guilty. It is submitted that the 2nd respondent has all the documentary evidence which will prove the case against the accused beyond all reasonable doubt. 7. Heard the learned counsel for the petitioner, learned counsel appearing for the 2nd respondent and learned Assistant Public Prosecutor for the State. 8. There are serious allegations in the complaint and money of the bank is involved. As such, this Court is not inclined to entertain the petition any further. 9. Accordingly, the Criminal Petition is dismissed.
